Where's the proof?!

Another FABULOUS letter from the ever unprofessional, immature, illogical, and mystifying ACHOA President, Joseph Bitsky. He says not to listen to the hearsay, lies and assumptions by providing us with hearsay, lies, and assumptions.
Joe Bitsky's proof that he had a Real Estate license is his signature on the wall or ceiling of Key Realty... funny, every Real Estate agent that I know has an actual piece of paper from the State of Nevada. I guess it is impossible for someone unauthorized to sign a wall, there are very strict standands when it comes to graffiti, don't you know.
I also find it interesting that he claims that the attorney was fired after being paid in full. Normally, when a contract has been satisfied, the company isn't considered fired... so, what truth REALLY lies beneath that statement?
Additionally, what proof does Joe Bitsy have that me and Cathy are responsible for the $6,000+ attorney bill?? None, it's just him saying it... AKA: hearsay.
Oh, and by the way... the neighbor that hasn't paid his assessments, he is a government contracted employee who was deployed to Iraq. Upon his return, he paid the ACHOA over $200 to make good on what Bitsky said was owed, but Joe Bitsky refuses to acknowledge that the ACHOA ever got paid (FYI: I have a copy of the cashed check that Bitsky said doesn't exist).
As for being selective... when I call the telephone number for the ACHOA, I am hung up on. Who ever is by the phone actually picks up the phone and disconnects the call so that I can't even leave a message on the answering machine. I also sent a certified letter to the ACHOA on January 25, 2010 ( all of my letters that are sent First Class get "lost in the mail" according to Bitsky ) which was refused, sat at the post office for 30 days, and has been returned to me as unclaimed on February 25, 2010.
Lastly, when I reviewed the documents as Mr Bitsky stated in his letter, there were missing bank statements, missing contact agreements, missing tax statements, missing utility bills, missing credit card statements (yes, there IS an ACHOA Wells Fargo business credit card that had a $4,400+ balance as of 06/2008), missing meeting minutes, and much more. Joe Bitsky was advised by the attorney, who was hired by the ACHOA, that he needed to provide ALL of the missing documents which was required by law. At that point Mr. Bitsky accused the attorney of conspiring against him and said that he was hired to find loop holes to protect him (Bitsky). Mr. Wiley advised Bitsky that he was hired by the ACHOA, that he was there as a representative of the ACHOA and was not hired to lie and/or deceive in order to protect Bitsky.
I look forward to the next entertaining letter from the ACHOA!!!

Power hungry

The ACHOA is now attempting to enforce NLV laws by fining residents that operate ATV's on public streets. While these people and vehicles are posing NO threat to anyones safety, the ACHOA feels that it has authority to enforce city codes. Reality check: only if we lived in a gated community, can the HOA restrict vehicles on the enclosed roadways; However, ALL roadways located in and around the Autumn Chase Community are PUBLIC, which means that the HOA can NOT restrict access.
The ACHOA is a power-hungry, money-pit that needs a change of leadership!!1

Home deliveries

The ACHOA (read: Joe Bitsky) is now saying that anyone who gets anything delivered to their homes is running a business. So forget that you need a new washer, dryer, or fridge... if it's delivered in a truck, you are running a business! This is a guy who runs a property management company out of his house, even though got busted by the NRED in 2006 for managing properties without a license... and he STILL in unlicensed yet he manages several properties in our neighborhood!
This is just more illegal activity that can no longer go unnoticed.

2009 Update

The ACC newsletter have been handed out, now I am just waiting for the back-lash from the ACHOA President. Not surprisingly, some homeowners have not received anything from the ACHOA regarding the upcoming ACHOA meeting. Fortunately, the newsletter had a page added with the date, time and place of the meeting.... NRS 241, which says that, per Nevada law, Common-community meetings are open to the public. This NRS was also listed on the supplemental page of the newsletter.
Has anyone been given a warning by the ACHOA regarding do repairs on vehicles?? If you have, keep in mind that Joe Bitsky, President of the ACHOA, regularly performs repairs on his vehicles in the street and driveway, which is in direct violation of ACHOA CC&Rs. I guess it's do as I say, not as I do.
I have sent two written complaints to the ACHOA regarding Mr. Bitsky... they were sent via Certified/Return receipt mail so there is no denying that I mailed them. The first is against him for doing repairs on his vehicles in places other than his garage. The second is also against him for the way he treated me and my wife when we attempted to contact the ACHOA regarding a discrepancy in our Assessment Statement.

I sent out the remaining letters to all of the homes in our community today, as well as any owners listed on the Assessor’s website that lives else where.  I hope that this venture is successful, despite certain people who wish to keep the owners/residents in the dark.  If you have any problems or questions, I am almost always available...  just call or email me.

I started mailing out letters to all homeowners and residents today.  I should have them all mailed by weeks end.  I will most likely hand deliver a separate newsletter so that I know that ALL residents receive one.  I won’t just pick a select few households or “friends”...  I’ll will send them to everyone.

Most of us have probably received the most recent HOA letter giving the results of the election on October 4th, which also included more unprofessional soapbox propaganda from the HOA President, Mr. Joe Bitsky.  

    The “information” that he shares in this letter is not factual, it is a distortion of the facts.  He was referring to me when he wrote about a “supposed” board member... the facts are, as many of us who attended the election meeting in March will remember, that I WAS elected to the board.  That can not be disputed.  Facts, Mr. Bitsky...  provable facts.

   Also he claims that, through smart accounting and good management, he is able to keep our assessments at $16 per month. What he has never revealed is that he opened a Wells Fargo business credit card for the Autumn Chase Homeowners Association a year or so ago.  The statement dated  06/17/08 shows a balance of $4,410.39 ($8,832 is the maximum that can be collected through assessments).  Mr. Bitsky NEVER mentioned this debt (as is required by Nevada law) to the homeowners and would not provide any other statements or receipts (as required by NRS 116.31175) to show what was charged to this credit card. This debt is OUR (the homeowners) responsibility. This credit card information is FACT.  Jason Wiley, the ACHOA’s attorney, is a witness.

  This is just the tip of the iceberg.

The Truth about the ACHOA of NLV, NV

The current President of the ACHOA in NLV, NV, hides the truth about the Association with lies, deceit, and cover-ups. 
    NRS and CC&Rs  state that we MUST have an association meeting once per year and MUST have an annual election for board members.  The ACHOA was chartered in December of 2001.  Since that time, there have been 3 (yes, only 3) meetings.  According the the Nevada law, there should have been at least 7.
     According to NRS, the association MUST be audited by an independent Certified Public Accountant once every 4 years...  it has yet to be done.  There is also no record of that the Federal taxes have been filed for 2006 or 2007. 
    The current president of the association has been in complete control of the ACHOA since at least 2004 and REFUSES to abide by Nevada law to allow homeowners to review all of the ACHOA documents... he even disregarded the associations attorney, who advised him of his legal obligation.
He even filed false documents to place a lien, and subsequent foreclosure, on a homeowner.  He claimed that the homeowner purchased his home illegally and never paid association assessments, even though the homeowner has a cashed/cancelled check for over $200 that was payable (and cashed) to Autumn Chase Homeowners Association.
    A goggle search of the ACHOA president resulted in several Nevada Real Estate CIC meeting minutes that said that he was a CONVICTED felon.  

   Homeowners, we are in BIG trouble when this man bankrupts the association and we are all left to foot the bill.
