Having served five years on our HOA board, I can see how those elected can get carried away. The biggest hurdle is getting homeowners to participate in more than just paying their assessments. Many of us homeowners fail to realize that it is OUR association and that WE are in control of how it's run. Many of us have been conditioned to believe that the law and/or rules that are in place are written in stone and we can do nothing but obey, but the fact is that WE, the homeowners, can make, amend, and eliminate rules. WE, the homeowners, elect board members not to be the dictators, but to simply run the day to day business of the HOA... at the end of the day, the HOA belongs to ALL of us.
As we've seen in the KTNV 13 HOA Hall of Shame, many HOA board members in the Las Vegas Valley intimidate and abuse their perceived power to extort homeowners. The Hall of Shame has also shown us that homeowners can take a stand and, with a little effort, remove the dishonest board members... some times, with those thieving former board members going to jail.
Our HOA has taken five long years to get back to good... we still have a long way to go before we are completely financially stable, but the light at the end of the tunnel is getting close. Thank you to all of the homeowners who take the time out of their busy schedules to voice their concerns, attend meetings, and help when ever they can!

The "new" ACHOA...
Here is some more truth about the the ACHOA: After taking over the HOA, the current board has taken the financial situation of the HOA from bankrupt to sustainable in less than two years; the current board has had regular meetings; the current board has had elections every year; the current board has not had a single outburst or fight during ANY on the meetings; the current board has never had to call the police during or after an HOA meeting; the current board has maintained open communication with the homeowners; the current board made improvements to the common areas.

The Never-ending Saga of a Little Man...
Some homeowners received an "anonymous" letter bad-mouthing the current ACHOA executive board and the property manager. [yawn] Here we go again! Mr. Bitsky is back to his passive-aggressive, terroristic ways: using his "right" to mail letters to people to try and get that control back. HA! Good luck with that, Jo-Bo!
Frankly, none of us really care what Bitsky has to say... his credibility is shot to hell. He is the laughing stock of not just the neighborhood, but in the nation. His "teachings" will make us laugh for years to come.
This guy who got caught lying, stealing, and was removed from the HOA board by the state, but can't seen to admit that he is defeated. The fact is that he can't stand that he lost control, that he no longer has power over the homeowners, renters, and HOA. Life is good!

Will it ever end?
Another piece of terroristic mail from "Anonymous" Joe Bitsky came in our mail. Will this ever stop with his mindless rhetoric?! Jo-Bo Bitsky: just pay the homeowners back what you stole and let us enjoy our neighborhood... Stop being the grumpy old man that everyone hates... Just keep to yourself.

Bitsky has lost the battle... he just refuses to admit it.
After a long and torturous 4 years, the Autumn Chase HOA is finally getting back on a somewhat "normal" road. Even though the State of Nevada has dropped the ball regarding pressing charges and collecting the money that they fined the Bitskys, the current board was able to sue Joe and Barbara Bitsky for the amount that the NRED determined they had stolen.
The ACHOA went to small claims court... and won. Yup, an actual court of law awarded the ACHOA several thousand dollars. However, the Bitskys STILL refuse to recognize the authority of the court. That's ok... because of that court ruling (by the way, the Bitsky's counter-claim against the ACHOA was denied!), the ACHOA is able to send the Bitsky's to collections.
Oh yeah... if any of you think that Bitsky was the victim in all of this (some thing joe Bitsky has claimed from day one), just ask his step-son and the NLV Police... Joe-bo just can't stay out of trouble, can he?!

The truth continues to surface...
I am sickened by what we have found... In the months leading up to their removal from the board, the Bitsky's fined several homeowners hundreds of dollars without a hearing or even legitimate reason. Words can not describe how I feel about how these honest, hard working people were taken advantage of, some for almost 10 years! Justice is coming... justice WILL be served!

Moving on...
Well, the new and REAL election is under way and in about a month, the ACHOA will begin it's rebuilding process. We have been left with a HUGE mess!
Some of the materials, such as the list of owners and their respective addresses, that were provided by the Bitsky's are almost five years out of date! So, as expected, the Bitsky's are in no way cooperating. Hell, Mr. Bitsky was even seen tampering with the common area irrigation system, which now needs to be repaired.
This will be a long road to recovery... thankfully, the Bitsky's will no longer have their grubby hands in the cookie jar!

The Verdict is in: GUILTY AND REMOVED!
On October 8, 2012, the Commission for Common-Interest Communities, Condominiums and Hotels (CICCH) unanimously agreed with the Nevada Real Estate Divisions' (NRED) findings and accepted the NRED's recommended discipline.
THE BITSKY'S HAVE BEEN FOREVER REMOVED FROM THE AUTUMN CHASE HOMEOWNERS ASSOCIATION! THEY CAN NEVER SERVE ON ANOTHER HOA IN THE STATE OF NEVADA!
They were ordered to pay restitution of over $10,000 to the ACHOA, they were fined over $80,000, and they are required to pay over $22,000 for the NRED's investigation. Folks, that's over $100,000!!! Well, Mr. and Mrs. Bitsky, start selling your shit and get the fuck out!!

The Bitskys were given chance after chance to dispute the allegations... chance after chance to literally beg the Commission to be lenient... but instead they continued their lies and misinformation, thinking that they are smarter than the Commissioners. Guess what? It didn't work!!!
Thanks to the Bitskys, the homeowners now have the tough task of basically starting over from scratch... with no money. The homeowners will have to dig deeper in their wallets to pay for a certified property manager. We ned to rally together and forge ahead. The silver lining in this story is that we do have GREAT people living here and they really do want to be invovled. Now that the dictator is gone, (for good!) no one needs to live in fear any more.
You know, Mr. Bitsky was right about one thing: two people destroyed our community.

CICCH Hearing on Oct 8 and 9...
Well, expect the Bisky's to start blaming everyone else again and, judging by the latest letter from the ACHOA, the BOD will be representing themselves "to save the homeowners money." How ridiculous! Well, if the reserve account was properly funded, the ACHOA would have the money to defend the board against the "false complaints and lies" by those two "illegals."
You know, Mr. Bitsky bitched at the beginning on the hearing that he "didn't have time" to get an attorney because he and Barbara were in Huntington Beach taking care of Barbara's dad until the end of July, that the hearing was a complete surprise. Hog wash! The investigation started in 2010... that's two years of preparing! Not only that, but Joe himself was the one who signed for the certified letters that contained the formal complaint back in June.
He obviously thinks that the commissioners, the homeowners, and everyone else are complete fools. Seriously, he actually thinks that we should believe him just because he says so.
Well, JoeBo, we check the facts! We can read!
Let us talk about that letter to homeowners, shall we? Well, the ACHOA BOD wants us to believe that Joe Salvatore and Cathy Aja told the NRED/Ombudsman complete lies and gave false information just to get the board members in trouble. The problem with that is, after a full investigation, the findings were MUCH, MUCH WORSE than our initial complaint. I mean, really... if we told complete lies, wouldn't the NRED drop the case? If we gave false information (which is illegal) wouldn't the ACHOA push to have criminal charges filed against us for filing a false report? C'mon, JoeBo... really?!
Does anyone really believe that the Secretary/Treasurer can pay himself 50% of the annual budget? The Bitsky math is horrible... and it's obvious that he has no understanding of what can be reimbursed and/or itemized on a tax return for a business or an individual. Any first year accountant would face-palm after reading the first sentence about the budget.
Lastly, how in the world does Bitsky expect us to believe that "all of the bills are paid" when the ACHOA carries a credit card balance, month after month... collecting interest? Plus, he also admitted that he paid the credit card bill late... so, basically, the ACHOA doesn't collect enough money to pay the bills, but it has enough money to pay interest and late fees?!

We have gotten the word that the disciplinary hearing against Joseph and Barbara Bitsky, Helen Murphy, and the ACHOA will be on October 8 and 9, 2012. It will be held at the Grant Sawyer Building again.
The hearing is open to the public and any one may attend. Please come and see first hand how the Bitsky's REALLY behave... you'll be in for a treat!
What I find sad is that nothing of this hearing and/or legal mess has been communicated to the homeowners of the ACHOA. The Bitsky's will, no doubt, try to hide this debacle just like how they tried to hide how they have been using the HOA's money to enrich themselves. The only communication to homeowners has been a letter saying that only two homeowners will be responsible for raising our dues and force the HOA to hire a management company... Of course what letter didn't say is that those two homeowners are Bitsky and his wife.

The disciplinary hearing for the ACHOA, Joseph and Barbara Bitsky, and Helen Murphy finally began today. Obviously, there wasn't enough time in this session to complete the hearing so it stands in recess until late September/early October.
I am disappointed that the executive board will be allowed to operate as it has while we wait but, judging by today, it will be worth it!
Mr. Bitsky contradicted himself several times in his opening statement and continued to help prove the NRED's case against him. He claims that he and Barbara knew nothing of the hearing until July because they were in Huntington Beach taking care of Mrs. Bitsky's father, Oddly enough, there are several ACHOA credit card charges for Huntington Beach Hotel... weird!
Mr. Bitsky's defense for the alleged personal charges on the credit card is that there is no evidence to disprove his testimony that the charges were for the HOA... consequently, he refused to provide any receipts to support that they were for the HOA. Ooops!
I look forward to when the hearing reconvenes because I think it will get VERY interesting when Mr. Bitsky takes the stand.

August 15 is the day...
We sat and waited for our case to be called but the case before ours was painfully s-l-o-w. I give the commission props for being patient and more than fair with this Spears guy....
Anyway, the case against the ACHOA, the Bitsky's, and the apparently ill Helen Murphy will be tomorrow, August 15. We will update the various media outlets as soon as we are able!

The Truth...
According to the official complaint that was filed by the NRED, the Bitsky's used over $10,000 of the HOA's money for their own personal use between 2008 and 2010.
I cant imagine how much more if they had checked back to 2004 when they first had control if the HOA.
I'm not a cop or an attorney but I think this falls under several CRIMINAL violations... In addition to the 150+ civil violations that the NRED found.
August 14, 2012, will be the big day... At least two of the complainants will be attending the hearing, so that we can see if first hand.

The date is set: August 14 -15
Several of us received an email today informing us that the CICCH hearing for the case against the ACHOA and it's current executive board ( Helen Murphy, Joseph and Barbara Bitsky) will be held on August 14, and may run until August 15.
The board/ACHOA must be represented at the hearing, or a default judgment will be awarded. Many of us look forward to seeing how this plays out, especially since the ACHOA's board has been refusing to cooperate will the process.
A few of us will be attending the hearing, and we hope to see people from our community as well.

Time is ticking...
I had a phone conversation regarding the NRED's case against the ACHOA... yes, it is on for August 13, 14, and/or 15.
The Bitsky's and the ACHOA executive board continue to deny the existence of an investigation, they also deny ever receiving the notice of the hearing that was sent via certified mail. Well, living in denial will only make it worse for them.
We filed the complaint because we saw a major problem with how the ACHOA was being run. The Bitsky's refused to listen to reason and, instead, began a smear campaign against a few of us for questioning how the HOA was being run. Plus, even after being notified of an investigation, the executive board refused to comply with the law and the Ombudsman's office.
There is no less than 46 parties that have a vested interest in how the ACHOA is being run... No less than 46 parties that deserve to be treated fairly... Well, we are fast approaching the day when the lies, deceit, and harassment will come to an end!
I want to thank all of you that have shown your continued support!

The CICC is fast approaching...
We are but a few short weeks from CICCH meeting where the ACHOA violations will be heard. The ACHOA executive board still refuses to acknowledge that the NRED has found 150+ NRS violations and also refuses to acknowledge the authority of the NRED/Ombudsman's office.
This will be an interesting couple of months... We all are waiting with bated breath. The meeting is August 14 - 16, and the agenda will be published the week before.

Heeeee's baaaaack!
Well, it appears as though Mr. Bitsky has started posting on VegasHOA.com again. More unbelievable denials and more complete lies/fabrications! He claims that the letter was "generated by the Sociopath." (I really don't think that he should be calling David Garrick names.) He also claims that the letter shown by Darcy Spears was from 2011, not certified and was authored by the NRED legal administror. Well, I guess he didn't see the video... at around the 3 minute mark, there is a clear, up-close shot of the date and heading. Ooops! Bitsky must have "forgot" to see that.
In a strange sort of way, it's good to see Bitsky is still his same old self... I can't wait until the CICCH hearing in August!! Keep is coming, JoeBo the Clown!

After watching the video that aired on Channel 13's website (KTNV video), we can clearly see the first page of the letter addressed to the Autumn Chase Homeowners Association's Executive Board. Below is what is written in the first page of that letter (thank you, Hi-Def TV!):

The latest truth about the ACHOA
KTNV Channel 13's Contact 13 Investigator, Darcy Spears, presented a letter to viewers Sunday night, that tells us what charges the ACHOA and its executive board members are facing. Over 150 violations of 16 different NRS statutes. WOW!
Mr. Bitsky, and the BOD, have always maintained that they are acting legally and with the associations best interests. They also claim that the only problems the HOA faces is from a few "illegal" homeowners. Well, here it is.... is black and white... in writing... and soon to be in front of the governing agency in August. The Nevada Real Estate Division has "obtained sufficient evidence to commence a disciplinary action..." this includes failing to audit HOA funds; failing to hold proper elections; conducting financial transactions not in the association's interest and for their own personal gain; and failing to cooperate with the Division's investigation. This is in direct contrast to the October 29, 2011, letter sent out by ACHOA to homeowners that states: "we did an audit by an Auditor II, and a discussion with a Representative of the Real Estate Commission, there was nothing wrong with our financials or the governing Documents, and issues being raised by two people were found to be invalid." In a letter sent to homeowners dated December 5, 2010, Mr. Bitsky claims that Joe Salvatore filed false complaints to the NRED... Well, according to this letter from the NRED, those complaints are actually valid.
In another letter by the ACHOA, dated January 1, 2011, the BOD starts by saying "The BOD in innocent until proven guilty by the authorities." Well, Mr Bitsky, we shall see you in August when the authorities have the hearing. Too bad you thought that the Ombudsman's office would drop the complaints because of the publicity. I guess a better decision would have been for the ACHOA's BOD to actually follow the law and cooperate with the investigator.
The BOD made their bed, now it's time for them to lay in it... oddly enough, the Bitsky's don't appear to laying in their own bed/s for the last few months. We can't help but wonder where they could be and why they have disappeared? Please join us in August when the NRED's CICCH has the meeting to address the findings of the complaints against the ACHOA and it's BOD. We are all hoping that Mr. Bitsky shows up... it certainly would be great entertainment!
