The latest truth about the ACHOA

KTNV Channel 13's Contact 13 Investigator, Darcy Spears, presented a letter to viewers Sunday night, that tells us what charges the ACHOA and its executive board members are facing. Over 150 violations of 16 different NRS statutes. WOW!

 Mr. Bitsky, and the BOD, have always maintained that they are acting legally and with the associations best interests. They also claim that the only problems the HOA faces is from a few "illegal" homeowners. Well, here it is.... is black and white... in writing... and soon to be in front of the governing agency in August. The Nevada Real Estate Division has "obtained sufficient evidence to commence a disciplinary action..." this includes failing to audit HOA funds; failing to hold proper elections; conducting financial transactions not in the association's interest and for their own personal gain; and failing to cooperate with the Division's investigation. This is in direct contrast to the October 29, 2011, letter sent out by ACHOA to homeowners that states: "we did an audit by an Auditor II, and a discussion with a Representative of the Real Estate Commission, there was nothing wrong with our financials or the governing Documents, and issues being raised by two people were found to be invalid." In a letter sent to homeowners dated December 5, 2010, Mr. Bitsky claims that Joe Salvatore filed false complaints to the NRED... Well, according to this letter from the NRED, those complaints are actually valid.

 In another letter by the ACHOA, dated January 1, 2011, the BOD starts by saying "The BOD in innocent until proven guilty by the authorities." Well, Mr Bitsky, we shall see you in August when the authorities have the hearing. Too bad you thought that the Ombudsman's office would drop the complaints because of the publicity. I guess a better decision would have been for the ACHOA's BOD to actually follow the law and cooperate with the investigator.

 The BOD made their bed, now it's time for them to lay in it... oddly enough, the Bitsky's don't appear to laying in their own bed/s for the last few months. We can't help but wonder where they could be and why they have disappeared? Please join us in August when the NRED's CICCH has the meeting to address the findings of the complaints against the ACHOA and it's BOD. We are all hoping that Mr. Bitsky shows up... it certainly would be great entertainment!

NRED/CICCH meeting in August

The complaints have been investigated, the findings have been forwarded to the Commission, and the Bitsky's are on the run. Mrs. Murphy has been left holding the hot potato... No doubt that the Bitsky's and Murphy will cry foul because they never got the certified letter, which, I think, partially explains the reason why the Bitsky's haven't been home for several months. No matter, receipt of the letter is irrelevant. I am predicting that the CICCH Commission will make a default judgement AGAINST the ACHOA and it's board members. The problem lies in getting the ACHOA files/property away from the current board, out of the Bitsky's home, and into the competent hands of the concerned homeowners. Well, they can run but they can't hide... the IRS will find them. Happy trails and good riddance, August can't come soon enough!

Where in the World are the Bitsky's?

We are expecting to see the complaints against the ACHOA, and it's board members, go infront of the CICCH Commission in either May or August. It seems that the Bitsky's aren't expecting it to go in their favor. They have not been home for more than a few days in the past several months, all three vehicles have disappeared, and the lights are obviously on timers. When we add this to the fact that the Bitsky's loaded up a Uhaul when they were first noticed about the complaints last year, one can't help but conclude that they are preparing to make a quick getaway when the verdict comes out... if they haven't left already! Should the CICCH remove them, I am terrified to see what damage has been done. A decade of incorrect book keeping, a decade of grubby hands raiding the cookie jar... and Lord knows how many loans and/or credit cards they opened under the ACHOA name that were used for personal gain! Well, we can only hope that the homeonwers that make up our community aren't stuck with an enormous bill.

NRED update

Even though the ACHOA, the Bitsky's, and Mrs. Murphy deny that they are under investigation, the complaints filed against them have been moving forward. Because it's an open, current investigation, no information is available about the findings. However, we are keeping a close eye on the NRED's website for the case to show on the commission's agenda... We will keep you posted. our next blog post: "where on earth are the bitsky's?"

A new year... what will it bring.

Well, we started a new year and I wonder what we have in store for those of us who reside under the ACHOA's self-proclaimed regime. Although, the ACHOA's board members continue to deny it, there are several complaints still being investigated by the NRED regarding misuse of money, failure to follow proper procedures, as well as many others. I have a feeling the this will get resolved this year. Darcy Spears has remained in touch with us and still has an interest in our story, so hopefully we get more attention on the horror that we call living in an HOA.
The ACHOA has been pretty quiet the last few months, I can't help but wonder what the have up their sleeves. I am, no doubt, waiting to be entertained!
Anyway, I hope this year is prosperous for us all!
